Family Law
Family Law in Toowoomba, the Darling Downs, surrounding areas & beyond
Family law matters are rarely straightforward. Separation, parenting disputes, and the breakdown of a relationship affect every part of your life, from your finances and home to, most importantly, your children. Getting the right legal advice early can make a significant difference to the outcome.
At Millar Trost Legal, our family law team is led by Elizabeth Millar, one of Toowoomba’s most senior practising Accredited Family Law Specialists. With over 22 years of experience, Elizabeth brings a calm, focused approach to even the most complex family law matters, always working toward the best possible outcome for her clients.
We assist clients across Toowoomba, the Darling Downs and surrounding areas with all aspects of family law, including property settlements, parenting and child arrangements, divorce, and domestic and family violence matters. Similarly, we can also assist clients interstate, given that the Family Law Act applies across the whole of Australia.
Our Approach to Family Law
We understand that family law matters are deeply personal and the decisions made during this time can have long-lasting consequences. Our priority is always to resolve matters as efficiently and cost-effectively as possible, without unnecessary conflict or litigation.
Where out-of-court resolution is achievable, we will pursue it. Where it is not, we will not hesitate to advocate strongly for your interests in court.
Our Family Law
Expertise
Property Settlements
Separation can have immediate and serious consequences for your financial security. In Australia, there is no automatic 50/50 split of assets. The outcome depends on a range of factors including each party’s contributions to the relationship and their future needs.
Our team provides practical, strategic advice to help you understand your entitlements and reach a settlement that properly protects your interests, whether through negotiation, mediation, or court proceedings.
Key areas we assist with include:
- Division of property, superannuation, and financial assets
- Binding Financial Agreements and Consent Orders
- Property settlements for both married and de facto couples
- Time limit advice – strict deadlines apply after separation or divorce
Parenting & Child Custody
When children are involved in a separation, getting the arrangements right matters above all else. Australian family law focuses not on the rights of parents, but on the best interests of the child, including their right to be safe, and to have a meaningful relationship with both parents where it is appropriate to do so.
Our team assists parents in reaching workable, child-focused parenting arrangements through negotiation and mediation, and represents clients in the Federal Circuit and Family Court of Australia where agreement cannot be reached.
Key areas we assist with include:
- Parenting Plans and Consent Orders
- Parenting arrangements involving domestic and family violence
- Urgent parenting applications
- Relocation matters
Divorce
Applying for a divorce in Australia is a straightforward legal process based on a no-fault principle – the only requirement is that you have been separated for at least 12 months. Our team will manage the entire process from start to finish, including all documentation and Court correspondence.
It is important to note that divorce and property settlement are separate legal steps. Time limits apply to property applications once a divorce is granted, so we encourage clients to seek advice early.
Domestic & Family Violence
Domestic and family violence takes many forms and can be difficult to recognise. Our team assists both people seeking protection orders and those responding to applications, approaching every matter with care, sensitivity, and without judgement.
We understand the significant overlap that frequently exists between domestic and family violence proceedings and other family law matters, and will ensure your interests are protected across all related proceedings.
